Eager to Motivate Fitness, LLC E2M Referral Program Terms & Agreement By participating in the E2M Referral Program (the “Program”), you (“Participant”) agree to the following terms and conditions set forth by Eager to Motivate Fitness, LLC (“E2M”):
  1. Participation & Acceptance
By enrolling in or participating in the Program, you acknowledge that you have read, understand, and agree to be bound by these Terms & Conditions.
  1. Program Overview
The Program is a referral-based rewards program in which eligible Participants may earn rewards for qualifying referrals. Rewards may be applied toward E2M Premium monthly subscription payments or issued as cash payments, at E2M’s discretion and in accordance with Program structure.
  1. Eligibility for Rewards
Rewards will only be issued for referrals that:
  • Result in active, paying accounts; and
  • Remain in good standing
Accounts that are on hold, have failed payments, are canceled, or are otherwise not in good standing are not eligible for rewards.
  1. Payment Timing
Rewards are typically processed and issued on a monthly basis, subject to a minimum seven (7) day holding period from the date the qualifying referral criteria are met. E2M reserves the right to modify the timing, frequency, and method of reward payments at any time, at its sole discretion, with or without notice.
  1. Payment Information & Responsibility
E2M currently issues reward payments via PayPal; however, E2M reserves the right to modify or change payment methods at any time, at its sole discretion, with or without notice. Participants are solely responsible for:
  • Providing accurate and current payment information, including a valid PayPal email address where applicable; and
  • Maintaining up-to-date and accurate information within their selected payment account
E2M is not responsible for payments sent to incorrect or outdated information provided by the Participant. Refunds, reversals, or reissuance of payments will not be provided under any circumstances due to incorrect payment details.
  1. Fees & Taxes
  • Any fees associated with receiving payments (including but not limited to payment processor fees such as PayPal) are the sole responsibility of the Participant.
  • Participants acknowledge that third-party payment providers may issue tax documentation (including but not limited to IRS Form 1099) if applicable thresholds are met. E2M is not responsible for tax reporting or obligations related to rewards earned.
  1. Program Changes & Payout Structure
E2M reserves the right to modify, adjust, suspend, or terminate the Program, including but not limited to reward amounts, payout structure, eligibility criteria, and payment methods, at any time and at its sole discretion, with or without notice.
  1. Fraud, Abuse & Withholding
E2M reserves the right to withhold, delay, deny, or revoke rewards at its sole discretion in cases of suspected fraud, abuse, manipulation, or any activity deemed inconsistent with the intent of the Program.
  1. No Employment or Agency Relationship
Participation in the Program does not create any employment, partnership, joint venture, or agency relationship between the Participant and E2M.
  1. Promotion & Compliance
Participants are solely responsible for ensuring that any promotional activity conducted in connection with the Program complies with all applicable laws and regulations and does not misrepresent E2M or its services.
  1. Limitation of Liability
To the fullest extent permitted by law, E2M shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to participation in the Program.
  1. No Guarantee of Earnings
Participation in the Program does not guarantee any level of earnings or rewards.
  1. Termination of Participation
E2M reserves the right to terminate or suspend a Participant’s access to the Program at any time, for any reason, at its sole discretion.
  1. Non-Transferability
Participation in the Program and any rewards earned are non-transferable.
  1. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
